Co-ownership with kennel means we, the kennel, hold half ownership of the dog. Our name(s) shall be listed first on the registration papers and the original paperwork from the AKC shall be forwarded directly to us. A copy of the original registration paperwork shall be forwarded to the new owner. The new-owner shall be listed as a co-owner on this dog/puppy until this contract has been full filled. If the dog is bred before it is 2, either accidentally or purposely, then the new owner shall relinquish the rights to the dog, return the dog to the kennel along with my (the new co-owner) signature on its original AKC registration and NO monies shall be refunded. We, the kennel, have the right to repossess the dog if the kennel should find out that puppies have been produced without their consent during the duration of this co-ownership contract. I, the buyer, understand that any breeding must be presented to the kennel in writing with copies of the AKC pedigree of the other dog that is being bred, proof of all vaccinations must be current on both male and female that are to be involved in the breeding, plus all blood tests must be performed and copies presented to the kennel before the kennel will approve any breeding. It is the responsibility of the new owner to keep close attention to a female in heat. All puppies sold within the duration of this co-ownership contract shall be health guaranteed for 2 years, upon written proof that the new owner takes the dog/puppy to the vet within the first 72 hours of ownership from the kennel as well as the new co-owner. This is stated in the puppy contract of sale and health guarantee. If you are wanting to enter your new dog/puppy into any field dog trial, show event, conformation event or agility event and need our signatures, please forward the entry to us and we will sign any necessary paperwork to do so. We encourage all registrations into any field trail, show event, conformation event, or agility event. We, the kennel, do not guarantee the outcome of any event you so choose to place your dog in. we can not guarantee the adult size, temperament or ability in any trial or event OF THE SAID PURCHASED PUPPY/ADULT.
For puppies/adults sold with full registrations and co-ownership, we hold co-ownership for a minimum of 4 years and a maximum of 8 years after purchase depending on age of puppy when purchased. This will be determined upon purchase of puppy. Puppies being defined as any dog under 2 years of age. (If a puppy is purchased at 1 year, then the co-ownership will be held for a minimum of 3 years, and so on until the puppy reaches 4-8 years of age..) After the 4-8 year co-ownership expires, we relinquish our rights to the dog and give the new owner full breeding rights to the dog solely, sign the original registration paperwork and forward it to the new owner. ALL PUPPIES SOLD WILL HOLD THE KENNEL NAME ON THEIR AKC REGISTRATION WHETHER FULL OR LIMITED REGISTRATION IS GIVEN.
We also require that at least a veterinarian check is performed or a penn hip exam is done before a breeding may occur. We also require a breeding plan to be submitted to us stating why you would like to breed, who you would like to breed to, who you will sell the puppies to, etc, etc. The more information you provide to us, the better.
When a full registration is requested and a co-ownership/full registration given to any said puppy, and the new owner has the said purchased puppy fixed before the co-ownership expires, then the new owner shall owe the kennel a CO-OWNERSHIP RELINQUISHMENT fee of $2000 payable immediately upon of spay/neuter. I understand that full registrations are given to new co-owners on the assumption that breeding(s) shall take place within the co-ownership years.
If I, the new co-owner, decide to breed my pup after he/she turns 2 years of age, and if a male is purchased, I, the new co-owner shall not stud my male to any female not approved by the kennel and shall return 1/2 the stud fee of approved females back to the kennel. In the event that the kennel should want to breed back to the male that I have purchased, then the kennel shall retain that right and not pay a stud fee to the co-owner. I also agree that if I purchase a male, then the kennel reserves the right to list him under the studs of the "OUR DOGS" page and it is further agreed that if the kennel receives any inquiries of the male purchased, then those inquiries shall be forwarded to the new co-owner for evaluation. The new co-owner shall notify the kennel if they receive any interest for someone to breed to their male.
If a female is purchased, I the new co-owner, shall not breed to any male that is not approved by the kennel and shall return 2 pick of the litter puppies from approved males to the kennel at the appropriate age for the puppy to leave its mother with a full AKC registration per puppy. The kennel agrees that if necessary, the kennel shall whelp the unborn puppies at the kennel and I the new co-owner shall be responsible for any vet bills that come with any emergency that my female may have during birth. I agree to screen any potential puppy buyers and give the registration type as appropriate to new puppy buyers. The kennel shall assist the determination of registration type to potential puppy buyers. The only exceptions that shall be made to this paragraph will be made in writing and only on a case by case situations.
I also understand that when I purchase a pup on a co-ownership contract with full registration, then I agree that the kennel shall remain informed of the puppy's/adult's progress. This can be requested at any time during the duration of this co-ownership contract. The kennel reserves the right to request all health information, pictures and updates on the puppies. If I fail to provide proof of the initial vet examination within 7 business days of purchase, then the kennel reserves the right to reposes the purchased puppy without monetary compensation to me. If I fail to provide proof of the requested information at any time during the co-ownership contract period of time, the kennel reserves the right to reposes the dog at any time during the duration of this contract without monetary compensation to me. I understand that should the kennel exercise their right to repossession, I will voluntarily sign the AKC registration certificate back to the kennel without hesitation or be subject to legal action. I also understand that should I refuse to provide the information that the kennel may request, the kennel shall consider that a breach of this contract and reposes the dog immediately.
The
kennel holds co-ownership of this said puppy for ____ years from the date listed

(Puppy/Adult) CO-OWNERSHIP CONTRACT AGREEMENT
All of the above stated is agreed by both parties. The purchaser, being the new owner, and the kennel agree to abide by these stipulations. Should the kennel or the purchaser not abide by these stipulations, then the offending party shall relinquish his/her right to the dog with no monies exchanged to the other party immediately.
