PUPPY SALES CONTRACT
We, Melissa Rogers and Jason Kellenberger, representing Ariels Kennels and the buyer, ___________, hereby agree as follows: 

The Kennel hereby sells to the Buyer, for the amount of $___________   (total price of the puppy),  which is hereby acknowledged, for a (male / female) (German Shorthaired Pointer / Weimaraner) puppy/dog.  

I understand that the kennel shall assist my choice of the puppy based on my requirements in a puppy/dog. The kennel does not require me to fill out "an application" per se, but only to inform them of what I am looking for in a puppy. The kennel wants nothing more than to place the best puppy into the best home for him/her. The kennel shall evaluate each puppy at no less than 6 weeks of age (for new litters) to find the best match for my preferences. Color is not guaranteed on GSPs as they may/may not darken as they mature. *When I place the deposit, I will be notified when the litter has been born or when the puppy/dog will be ready for pick up or shipping. I understand that any and all deposits are NON-REFUNDABLE. My name shall be placed on the next litter's waiting list in the event a puppy is not available for me from the current litter or if something happens to the chosen puppy/dog prior to pick up or shipping. The puppy must be paid in full no less than 5 days prior to pick up or shipping. All shipping charges are above and beyond the puppy/dog price.

ALL PUPPIES/DOGS GUARANTEED UNDER THIS CONTRACT BY ARIELS KENNELS SHALL BE TATTOOED FOR IDENTIFICATION PURPOSES.

Upon Initialing Registration A or B, I understand this is the type of registration I have purchased with this puppy:

·        ____ A. Limited AKC Registration: the purchased puppy is never to be used for breeding purposes and to spayed or neutered no later than 8 months of age. Limited registration restricts any placement in conformation shows or breeding. It does allow any and all placements into hunt tests and field trials.  The health guarantee does not guarantee against belly button hernia, dew claws re-growth or under or over-bite with this type of registration

·        _____B.  Full AKC Registration**: Full registration allows all conformation shows, breeding, hunt tests, field trials, etc. We reserve the right to refuse a full registration on any puppy. The breeder does not guarantee that the pup purchased will be successful in any breeding/show/hunting program. The health guarantee DOES guarantee against belly button hernia, dew claws re-growth and over or under-bite with this type of registration.

THE KENNEL’S CERTIFICATIONS:
The Kennel certifies that this puppy is free from and not been exposed to the following:
1. Parvo virus / Para influenza
2. Adenovirus
3. Rabies
4. Corona virus
5. Distemper
6. Bordatella (Kennel cough)  
We can not guarantee that this puppy is free from internal parasites. We do, however, guarantee that the pup has been de-wormed several times and one or more vaccinations have been given to your puppy. A copy of the records will be provided upon possession transfer.

BUYERS CONDITIONS OF GUARANTEE OF HEALTH  

1.       You must take the purchased dog to the vet within the first 72 hours of ownership. If anything is wrong with this puppy within the first 72 hours, we will exchange the puppy. No questions asked. Please note that the Kennel is not responsible for any veterinarian, mailing, faxing or shipping costs, including those required in this contract.

2.       You must send a general health report to us for this guarantee to be valid either by fax, e-mail, or snail mail. If there is no proof of a vet exam and something is wrong with the puppy after 72 hours, the kennel will happily take the puppy back without an exchange or monies refunded.

3.       With just the vet exam, your pet will be health guaranteed for 6 months from the executed date of this contract. I understand that in the event of a genetic defect in the purchased puppy, I may have to wait up to one year for a replacement puppy.

4.       Your purchased puppy/dog has been started on NuVet Vitamins. This health guarantee will be extended 5 years from the date of execution if you keep your companion on these vitamins. You must order these from NuVet Labs at 1-800-474-7044. Your order code is 32927. A 3-day sample has been provided to you at no additional cost to allow time for shipping of the vitamins from NuVet directly to you. If within the 5 years, you stop giving the puppy his/her vitamins, this contract will be immediately voided.

5.       You must purchase a crate that is the correct size for your puppy/dog. *If shipping by airplane, this has been provided to you.

6.       The Buyer shall maintain the puppy in good condition, including adherence to a regular immunization schedule, heartworm preventative, supply a good diet, and a clean and safe environment.

7.       If I, the buyer, decide that I am unable to care for or keep the puppy/dog in my possession FOR ANY REASON, at any age of the dog, the kennel requires me to relinquish the puppy/dog back to the kennel. Shipping for the puppy/dog to be returned to the kennel will be at the purchaser's expense unless otherwise agreed to with the kennel in writing. Also, the kennel requires me to provide any and all health/shot records, AKC registration, along with any other documentation that the puppy/dog has had to the kennel upon relinquishment. The kennel reserves the right to agree to or refuse a full, partial or no refund of the purchase price (less the non-refundable deposit) of the dog upon relinquishment. E-mails shall be sufficient proof of any agreement between the purchaser and the kennel. If a refund is agreed to by the kennel, then only when the puppy/dog is replaced into a new home the refund shall be given. If the kennel is informed that the puppy/dog that is under this contract was given away or sold to someone other than the kennel or a representative of the kennel, then the buyer shall pay the kennel a breach of contract fee of $1500.00. The payment of this fee will only be accepted in the form of a US postal money order or cash. The kennel requires me, the buyer, to agree to this paragraph in its entirety by initialing here:_________

8. IF FULL REGISTRATION WAS PURCHASED: The buyer understands that the AKC registration on this puppy will be mailed via the USPS, return receipt requested, signature required so that the kennel knows that the buyer has received his/her registration papers.
   All Full Registrations will be placed on limited registration for no less than 2 years. In that time, you must place a title or award of any kind on the dog to prove breeding this puppy shall improve the breed. This title may be with the AKC, NAVHDA, NSTRA, GSPCA, WCA, or any other organization that will show the ability/conformation/training of the dog. If in the 2 years, you choose not to place any titles/awards on the dog, the registration shall remain limited until such titles/awards have been placed.  Proof of the title/award must be submitted to the kennel before the registration shall be changed. If this pup was purchased with the intent of a full registration and the above requirements have been met, no further charges shall be assessed for the change in registration.  All full registrations shall carry the “Ariels” kennel name in the beginning of the pup’s registered name. ___________initial here

9.       IF LIMITED AKC REGISTRATION WAS PURCHASED: The buyer understands that the AKC registration papers shall only be provided via the USPS AFTER I have provided the spay/neuter proof from a veterinarian. This proof must be verifiable via phone or fax. Limited registration can only be changed to Full registration if the difference in price has been paid, plus a $50 application fee and a letter explaining why you wish to have the registration changed. Upon receipt of this information by the kennel, the kennel shall review the information and make a decision based on the information provided. The kennel shall notify me their decision within 7 business days. THIS DOES NOT GUARANTEE ME A DEFINITE CHANGE IN REGISTRATION.

10.   Special requirements are listed:

Should this puppy die, within the first 6 months, the body needs to be sent back to the kennel or the veterinarian of the kennels choice for a necropsy (animal autopsy) to be done. Only upon results of necropsy (animal autopsy) shall a new puppy be exchanged for it. Payment of the autopsy shall be the responsibility of the kennel if the puppy has died from an infectious disease (within 72 hours) or by genetic defect (heart murmur, PDA, etc, within 6 months). The payment responsibility shall be on the buyer of the dog if the results are not within the kennels power to control. The place where the autopsy is done shall be the kennels choice. The buyer will have no more than 2 days to release the dog/puppy to the vet of the kennel's choice for the necropsy to be completed. Upon death, the puppy/dog MUST be placed into a freezer until the body can be delivered to the vet of the kennel's choice. This paragraph shall apply if the buyer chooses to obtain a new puppy.  

Examples of things that are beyond the kennels control are:

1. Poison
2. Car or tractor incident
3. Dog fight
4. Strangulation or mutilation
5. Abuse (defined as starvation, dehydration, chocking, beating, etc.)
6. Accidental shooting or other accident caused by the buyer or anyone the buyer chooses to care for the puppy.
The above paragraph shall apply for the duration of this guarantee.
